The woes bedeveling Fedinard waititu in Kenyan politics.

Former Kiambu Governor Ferdinand Waititu has missed a court session for the third time in his Kshs588M corruption case.

The case was to proceed on Monday but the Former Governor failed to show up.

According to his lawyer John Sakwa, Waititu contacted Covid-19 and is, therefore, undergoing treatment.

"My client has been unwell. He went for check up on October 24 and was referred to the High Dependency Unit for admission at the hospital.

"He was admitted and is not ready to proceed with the case," said the Lawyer.

The Lawyer further asked the court to exercise his independence saying his client had not missed court intentionally.

“This court has to be independent. My client has not failed to come to cour, the constitution says that an accused person has a right to be presumed innocent,” said Sakwa.

As result, the Director of Public Prosecution Noordin Haji is seeking to have Waititu’s bond release cancelled on the ground that he is evading trial.

Cancellation of bond terms will result to the Governor’s arrest.

The prosecution team requested the court to allow three independent doctors appointed by KMDP to examine the former Governor and file a medical report that will guide on the bond terms given to the Governor.

“That a team of three doctors appointed by Kenya Medical Practitioners and Dentist Board (KMDP) to do the health assessment and file the medical report for the court to assess the health status and for the DPP to make further applications,” the prosecution asked the court.

Also, the prosecution counsel led by Lawyers Victor Mule, Joseph Riungu and Faith Mwila asked the court to proceed minus the former Governor arguing that the former Governor was at fault in allowing the case to kick off.

The Lawyers argued that Waititu’s absence was a strategic plan aimed at delaying the case.

“The conduct of the accused person is meant to delay the hearing of this case; He has not indicated whether there will be a review. This court can’t be held in abeyance, we also go to the hospital and the doctors indicate when we should go back for reviews,’’ Lawyer Riungu told the court.

Last week, the former Governor failed to attend court after it was said that his doctors had prescribed him a one-week bed rest from October 17 to 24.

In August, the case was adjourned after the court was told that the former Governor had tested positive for Covid-19.

The prosecution team, then, agreed with a medical result from Lancet Laboratory about the Governor’s positive status.

Waititu was arrested in July 2019 after it emerged that he presided over the irregular award of tender worth KSh 588, 198, 328 meant for the development of various roads to bituminous standards in the 2017/2018 financial year.

He was arrested together with his wife and later released on bond.


As a citizen of this country, we should fight against corruption and it's clear that there are Alot of mind games being played in this former Governor's case. All in all we hope that it will be resolved amicably and just will be served even if it takes years like it always does in the Kenyan law court
